Terms and conditions
The terms that apply to our quotes and works.
This English text is a courtesy translation. In case of differences, the Dutch version prevails.
1. Scope
These terms and conditions apply to all quotes, contracts and works of TopKwaliteitBouw ('we'), unless agreed otherwise in writing. The customer's own terms only apply if we accept them in writing. The mandatory rules of consumer law always continue to apply.
2. Quotes
Quotes are free, without obligation and valid for 30 days unless stated otherwise. They are based on the customer's information and on what was visible during the site visit.
If something unforeseeable appears during the works, such as hidden defects in the existing structure, asbestos or stability problems, we report it immediately. Additional work is only carried out after the customer's written approval.
3. Prices and VAT
Prices are stated in the quote, together with the VAT rate. The reduced 6% rate only applies if the legal conditions are met, including: a private home first occupied at least 10 years ago, mainly used as a private home after the works, and an invoice addressed directly to the end user.
The customer confirms these conditions through the statement on the invoice and can object in writing within one month of receipt. If the conditions later turn out not to have been met, the customer must pay the difference, plus any interest and penalties.
Extra work and changes are discussed in advance and confirmed in writing (including by email or WhatsApp), with the additional price.
4. Execution and planning
Start and completion dates are indicative unless expressly agreed in writing as binding. Delays caused by weather, late deliveries, force majeure or changes requested by the customer do not give a right to compensation.
The customer provides free access to the site, as well as water and electricity. We keep the site as tidy as possible.
5. Right of withdrawal for consumers
If you, as a consumer, conclude a contract outside our premises (for example at your home) or at a distance, you can withdraw from it without giving a reason within 14 calendar days. For services, this period runs from the day after the contract is concluded. You can withdraw with a clear statement by email or letter, for example using the model form at the bottom of this page.
If you expressly ask us to start within the withdrawal period, on withdrawal you pay an amount in proportion to what has already been carried out. The right of withdrawal does not apply to urgent repairs or maintenance for which you expressly asked us to visit, nor to services fully performed with your express prior consent, where you acknowledged that you would lose your right of withdrawal.
6. Payment
Invoices are payable within 14 days of the invoice date, unless the quote states otherwise. A deposit or interim invoices are only due if the signed quote says so.
For consumers: in case of non-payment we first send a free reminder, with at least 14 calendar days to pay. Only after that may late-payment interest (at most the legal reference rate plus 8 percentage points) and a fixed compensation within the legal limits be charged: at most 20 euros for an outstanding amount up to 150 euros, 30 euros plus 10% of the amount between 150.01 and 500 euros, and 65 euros plus 5% of the amount above 500 euros, capped at 2,000 euros.
For business customers, the rules of the Act of 2 August 2002 on combating late payment in commercial transactions apply.
7. Handover
After the works comes the provisional handover. We inspect the works together; visible defects are noted in writing and repaired by us. The final handover follows after the period stated in the quote or, if none is stated, one year after the provisional handover.
8. Liability and insurance
We are liable under the legal rules, including the ten-year liability for defects that endanger the solidity or stability of the building or an important part of it (Articles 1792 and 2270 of the former Civil Code). Hidden defects discovered after handover must be reported within a reasonable time after discovery.
We are not liable for damage caused by normal wear, poor maintenance, materials supplied by the customer or works carried out by third parties.
For works covered by the Act of 31 May 2017 (residential construction requiring an architect), we provide an insurance certificate to the customer and the architect before the works start.
9. Complaints and disputes
Please send complaints in writing, preferably by email to topkwaliteitbouw@outlook.com. We will look for a solution together with you.
As a consumer you can also contact the Consumer Ombudsman Service (consumentenombudsdienst.be). Our contracts are governed by Belgian law. Disputes are handled by the court that has jurisdiction under the Belgian Judicial Code.
10. Privacy
How we handle your data is explained in our privacy and cookie policy.
